1. Who we are

These terms apply to purchases made on www.diablosugarfree.com by customers in Spain. The seller is B Healthy Limited, trading as Diablo Sugar Free, registered in England and Wales at 155-163 Golders Green Road, London NW11 9BX, VAT number GB144182134. Contact: suk@diablosugarfree.com.

2. The contract

Placing an order is an offer to buy. The contract is formed when we send you an order confirmation by email. The contract may be concluded in Spanish or English, and we will keep a record of it.

3. Prices and payment

Prices are shown in euros and include Spanish VAT at the applicable rate. Delivery costs are shown separately at checkout before you pay. We may change prices at any time, but not after your order is confirmed.

4. Delivery

Orders ship from our warehouse in Spain with GLS, normally dispatched within 48 hours and delivered within 5 working days. Delivery costs €5.49, and is free on orders of €30 or more. If we have not delivered within 30 days of the order, you may set a further reasonable period and, if we miss that, cancel and receive a full refund.

5. Right of withdrawal

You have 14 calendar days from the day you receive the goods to withdraw from the contract, without giving any reason. To exercise it, tell us clearly by email at suk@diablosugarfree.com before the 14 days expire. You can use the model withdrawal form in the annex, but you don't have to.

We will refund everything you paid, including the standard outbound delivery cost, within 14 days of being told, using the same payment method you used. We may hold the refund until we receive the goods or proof you have sent them. You pay the cost of returning the goods, which go to: Diablo Sugar Free, Polígono Veredilla III, 45200 Toledo, Spain.

6. Limit on withdrawal for sealed food

Our products are foodstuffs supplied sealed. In line with Article 103 of the Spanish consumer act, withdrawal does not apply to sealed goods that cannot be returned for health protection or hygiene reasons once unsealed. So we can only accept returns of unopened products in their original packaging.

7. Faulty, damaged or wrong items

This is separate from withdrawal and is not affected by clause 6. If an item arrives damaged, defective or is not what you ordered, contact us within a reasonable time and we will replace it or refund you in full, including delivery, at no cost to you. Your statutory rights under the legal guarantee of conformity apply.

8. Complaints

Write to suk@diablosugarfree.com. We will acknowledge within one month.

9. Liability

Nothing in these terms limits our liability for death or personal injury, fraud, or anything else that cannot be limited by law. Otherwise we are not liable for indirect or consequential loss.

10. Governing law and disputes

These terms are governed by Spanish law. As a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts of your own domicile.

11. Changes

We may update these terms. The version that applies to your order is the one published when you placed it.
